I think H-1B's should be paid more than average. The entire point of it was to hire talent you simply couldn't find in the US not find cheap labor. I think if it does happen there might be a lot of non-renewals since I am sure some places uses them just to get cheap labor.

Selfishly speaking, I work for a company that hires h1-b workers, not because they have rare skills, but because they're cheap. Not only are they cheap, their education and quality of work is poor compared to an equivalent cs major who studied in the states. I would guess they get paid at most half of what an employee makes.

So I'm all for this because I want to work with experienced and quality workers.

From a point of view of an international student, this does not look good for us.

We are already only restricted to top or mid tier companies as low level companies will not sponsor our visa. And top tier companies are already extremely difficult to get in, while mid tier companies are really specific on what they want from me. They  want me to know exactly what stack they use, or else they will hire someone else.

Will I be a good asset for US? Yes.

Will I be paying a good amount of tax with minimum return of service as I am not a citizen? Yes.

We knew this when we came over here, but it seems that with every new decree, we are being shown the exit door. Most probably a lot of experienced developers will benefit from this but the job market for new grads will become extremely thin.

I mean it’s no coincidence Shopify’s CEO announced massive hiring initiatives with a focus on foreign talent as soon as the H1B issue came up, France established a fast track tech visa in 2018 Trudeau has prioritized skills based immigration with a focus on tech, and Toronto has been the fastest growing city in NA for tech jobs since 2016.

I'd rather see it based more on education and job experience than salary to this degree.  Salary should be a component, but it already is.  What I'll hate to see is the educational institutions pulling the best and brightest international students, educating them in the US, and them having to just go back home because they no longer fit the new criteria.  The point of these programs is to get the best people to work here, not to keep them out.  

Some of the best engineers I've worked with started on H1Bs.  Some of those have green cards now and some are even citizens.  That's the point of these programs.  The companies underpaying are already going against the rules.  Making the rules stricter won't help that part of it.  It just limits the number of companies able to use the program as initially intended and harder for these best of the international workers to get jobs here.  This isn't winning.  Enforce what we already have instead.  It'll work better.

Companies abuse this program like crazy and the government turns a blind eye to it.  At times of high unemployment it is crazy to grant visas for a job where there is no shortage of talent (entry level supply chain position) already living in the US.  If the government actually enforced the rules around the program, there wouldn’t be so much fraud.  We have two developers, neither have any coding experiencing that we procured visas for - those jobs could have went to a citizen/green card holder.  There is absolutely nothing special about these two other than they are from the same country as the hiring manager.  It took them forever to get to a place where they added any value.

The one worry I have is that companies will just start hiring people from India (or wherever) and allow them to work from India.  So not only will that job go to someone outside the US but there will be no economic benefit, it will just be a drain of dollars out of the country.  I applied to a company that said you could live anywhere in the world and they would just treat you as a contractor if you were outside the US.  

This isn’t about race, btw, it’s just about taking care of your own first.  US citizens are unemployed due to the shift of industries and etc overseas, let’s take care of those folks before we start importing more people just because they’re cheaper.

I kind of expect that the truly difficult to fill positions may be hurt... though some will just pay more... but the shady ones will simply work on finding loopholes in categorizing the jobs so that it doesn't stop them.  I had so many interview calls when I first graduated that stopped the process when realizing I was a citizen... it was frustrating to see how many of the calls were for jobs that didn't even want to try to compete with US wages when requiring work in a not cheap US city.  If it's loophole free enough to cut those companies out, great.  If they find a real need after that for more low to mid level tech experience that can't pull those wages, then they can look at expanding or reworking other immigration options in non-shady ways.  Allowing it to expand outside its purpose just benefits companies that are willing to use those loopholes and pay lawyers for that advantage over other companies.

I had always assumed that many big companies use L1 visas over H1B in instances where they have an office in someone's country.

I'm British, but in my recent job hunts I've had some contact with companies in America that were looking for me to work remotely, with an aim of bringing me in on a visa in the future. The money they'd offer would be amazing for the UK, but very low in HCOL places like NYC or SF - and to be honest I think Covid is likely to make a lot of companies consider hiring in the UK due to the decent level of education and the relative cost of an experienced engineer. For that reason I can only assume it's a good thing for those that joined US companies remotely (likely as a contractor) with the expectation of a visa after 12-24 months.

I still find it kinda weird that America is stingy on bringing foreign talent in for high-tech jobs. Considering many of these jobs are in high-end industries, you'd think that they would open it up a little for companies that reach outwards across the globe and set up offices elsewhere.

I have a mixed team of data scientists onsite and remote, and the remote people are in Asia. Each one of those employees costs us 1/5 the salary of one onsite person. Most of our onsite people are H1-B. I could see the remote strategy growing in the future since they do very good work.

Instead of hiring one H1B worker at 75% of the cost of an American worker, they'd hire 3 foreign workers each at 25% of an American's salary.

1. This increase of minimum wage for H1b workers has similar effects as any other minimum wage increase: it hurts the workers. Specifically it hurts the foreign workers which had the chance to get H1b visa before, but now the salary requirement is too high, so only few high-level workers will be able to pass that high \[minimum wage\] bar.
2. Overall, stricter restrictions reduce international trade (less people can come to the US to  sell their skills).Reducing trade - reduces the effectiveness of overall global economy.
3. On the positive side: lower number of H1b workers will make sure that H1b quota is not reached. So that change will significantly reduce H1b processing delays... for the workers that still qualify.

Seems like a good move.

Selfishly, it helps me quite a bit.  I live in a HCOL, and a lot of the H1-B's that will be denied will be from LCOL.  So, my local companies will have more talent available, and thus even more jobs with higher wages due to the multiplier effect a good dev brings.

Weirdly enough, this hurts a lot of Trumpistan's tech regions like in the South.  A Houston, for example, will be hurt hardest, while a Silicon Valley won't notice it all.

Basically, this concentrates talent further into tech hubs and wage cutoff is a better correlation of whether an engineer is good or not rather than a idiotic lottery system.

Most of us don’t understand that even today majority of Full Time positions, 7/10 times is filled by Citizens or those who hold a Green Card.
But companies open a Full Time position only when they see a need in the long term or if there is an absolute need for talented people, which is rare in most Non-Tech Fortune x00 companies.

Most outsourced jobs are short term and don’t need special skills. When it comes to outsourcing it all comes down to the cost and ‘Yes Sir’ mentality. This is where the WITCH companies have a huge advantage.
 
I don’t expect this proposed overhaul to bring any drastic change in the situation of average Americans in the non-FAANG group.

The current system is so ridiculously bogged down with fraud it makes the legitimate raffle system pointless when there are countless sham consultants entering raffle after raffle with fake employers. The system needs a desperate overall. Maybe this exact change isn’t perfect, but it’s a step in a good direction IMO.

This is normalized by industry and location. I am a core engineer, think mechanical/materials and in my company area, wage level 2 is just about $100k and wage 3 is $120k. Most good companies pay at level 2-3. So it's not absolute in the way that this thread alludes to.

The H-1B is for skilled workers. Who says entry-level workers cannot be skilled? There is already the O-1 visa for distinguished, high-wage workers. If USCIS wants this to be fair, it should implement a points-based system that considers multiple factors—degree, age, wage, country of origin, and more. Don’t be lazy! Relying on wage level alone is shortsighted. Otherwise, it’s just a tool from the Trump Administration to prevent international students from working in the U.S.

H1Bs have been a lifeline for most of the innovation in US. China has a different system, a system where people at scale are very driven, disciplined and hardworking. By scale I mean something US cannot imagine. They also stick to their country. 8/10 best research in AI is happening in China. US has a system where they source these type of talent from other countries especially India to compete and dominate. US will never be able to adopt China’s system. An average American has a way way way 100x better shot in getting a job in open market anyday as opposed to an H1B holder. US citizens should not refrain from competing and putting more hours in these type of jobs as US is a capitalist market not a socialist as constantly reminded but governments here. Why does all this happen ? Cuz at the end of the day companies want to roll out faster to market, save cost and boost their markets value which adds to economy. Now they have to catch up and compete with China. Without these rigor at an optimum salary a capitalist economy will not be able to grow as it’s not a China model.

There is a whole slew of talent in India today who work in India and get paid handsomely. India has junk too but the younger crowd is way way smarter than its older counterparts. The no of start-ups getting funded is huge. Now these talents working in India will have access to these higher paying jobs. The low cost jobs will move to India in itself has its a low-cost and who cares ? All of these companies have centers in India. They can ship these jobs to IT services as well. They will never take the productivity hit, as again it’s a capitalist society and shareholders need to be satisfied.This new rule is not going to suddenly open up jobs if the market is not good. Citizens already have a 99% better shot at getting a job even today. Most people who complain is cuz they got fired due to their ability to not compete and there might have been a few H1bs. If you can compete with Indians companies will love you and h1b quota will not even be filled. Why should a company take so much of an effort to do paper work for temporary works if they think there is enough talent. Second, this will not incentivize students to study in the US. This will hit the harden against competition with China. That will again not work out well in the long run. 75% plus people who successfully started a startup in US are foreign born. If at all the amount of tax gained by government from them and the no of jobs increase due to the ripple effect easily makes H1b a very very important part of growth model. Stop complaining and start working harder in a field where you anyway have a way way better shot for the love of your capitalism.

Sorry?  H1B skilled labor visas are not done by lottery.  They are based on the country’s needs and require a certain from dept of labor.  The visa lottery is actually a lottery for nationalities underrepresented in the US.  Unfortunately they based their numbers on those legally present so nationalities with tons of illegals in the US would still qualify for the visa lottery.  I’d get rid of the visa lottery.  I’d keep H1B since it’s based on needs of the country.  I’d increase by a lot the unskilled work visa , H2B for construction, agriculture, restaurants, hotel industry and others.  I’d have the sponsoring companies deposit a hefty bond for each H2B worker.

Arguably the better solution here, which would be much easier to implement, would have just been improving the flexibility for an H1B worker to be allowed to work at any employer for the term of their status.

If an employer used an H1B in order to hire a foreign worker and then under pay them, the worker would just get another job that pays market rate, without the work status concern. Without the artificial control over the employee, H1B fraud, in this manner, wouldn't be worth it.

I'm disappointed to see an "overhaul" of the H1B system which does not address the indentured-servitude-esque nature of the system, and maintains the parts of the system which allow for extortionist behaviour.

That  sounds like a very thoughtful and ingenious idea , IMHO the program allowed so far some employers to take advantage of workers in hard situations ready to make profound sacrifices just to be able to receive the chance to become one day Greengard holders or even US citizens. The difference is that when we get into a situation like that we can give a 2 week notice and look for a better job and conditions. A worker on a "work" visa has no luxuries like that , he or he will have to bite their tongue and "suck it up" for the required period with that employer. He leaves the job, he might as well pack his suitcase and leave USA too. More or less such people  become slaves for the next several years. Until they can get the necessary papers to be able to change jobs and to keep their right to stay in the country. Meanwhile native to USA specialists cannot compete for the job as they are already accustomed to a "normal life and wage levels " and cannot compete with desperate "new comers" especially when the new comers have higher degrees and often getting the job is literally a matter of life and death. . When we came to USA I accepted and worked any job in any work conditions for any  wage as long as it put food on the table and paid for the apartment where we put the said table , (we were lucky and found a good table that someone had left with the garbage on the street).  No man with similar skills would have been any competition to me at that time .  I worked for 18 months below the minimum wage , double shifts. Later on my first real job I accepted such a low offer that after 4-5 years of serious  raises(2-3 times each year ) I still was earning lower than any kid "hired from the street" in that company.  Twenty years later when I go on a job interviews some employers still salivate when they hear my heavy accent as they begin calculating for how much "cheaper" they can get me.  So yes , I know that it is  a great idea to pay the skilled newcomers fair wages and and this way  the American citizens can get fair wages too.  It seems a win-win scenario.

I understand that many companies use H1-B as a way of basically making foreign workers captive in the U.S., while also making it harder for those in the tech labor market to find jobs or competitive pay. However, if this is not part of a larger strategy of immigration and labor reform, I don't see it working well. Companies are still free to outsource or to classify workers differently to get around the new restrictions. I can see this leading to closure of some offices in the U.S. in order to move entire I.T. departments overseas, potentially reducing the labor market even more than before.

Low quality article. The public hearing about immigration rules has never been about the immigrants. There is no such thing as “indians speak and US has to listen” stated in the article.

For H1b specifically, we listen to employers, immigration lawyers and trade unions, they dont go
around asking Indians in India nor Indian H1b holders how they feel about the quota.
